4. The bail cancellation application has been moved by one Kallu, who is infact is the complainant, on the ground that the present applicant obtained the bail by misleading to the court giving his wrong age as 37 years though as per the Aadhar Card his date of birth is 04.08.1986 and as on date he is 39 years old.
5. On the previous date the accused applicant was asked to be present physically and now today he is present in court and when this court asked about his age then he informed that he is 30 years old.
6. Admittedly, the victim is the daughter of the complainant Kallu and her date of birth is 04.03.2009, therefore, admittedly she is minor. In support of date of birth Aadhar card is also enclosed. The victim has another sister namely Fiza and her date of birth is
01.01.2004.
7. In the bail application marriage certificate is also enclosed, wherein, the name of the victim is mentioned as Nabiya with her signatures, which itself reveals that the alleged marriage took place with Nabiya and not Fiza.
8. Be that as it may trial has already been commenced and the applicant was languishing in jail since 19.12.2024 and for almost 7 months he was in jail and bail was granted on 15.07.2025, therefore cancelling bail at this stage is not proper particularly when trial is going on.
9. Accordingly, I do not find any ground to cancel the bail.
10. Accordingly, the bail cancellation application is rejected; however the Trial Court is directed to expedite the trial within six months.
