Learned counsel for the petitioner would submit that the petitioner was working as Sub-Divisional Officer, Water Resources Division, Kondagaon and was placed under suspension vide order dated 30.06.2022 (Annexure P/2) against which he has filed an appeal before the State Government, which has also been dismissed vide order dated 01.03.2023 (Annexure P/1) and the same is under challenge in the present petition. 3. Learned counsel for the petitioner would further submit that during pendency of the present petition, the respondents No. 2 and 3 recommended for revocation of suspension of the petitioner and sent their recommendation to the State Government on 22.04.2024 (Annexure P/9) and 13.06.2024 (Annexure P/10), but the same is under consideration before the State Government, and till date, the suspension of the petitioner has not been revoked. Therefore, he confined his submission to the extent that, the respondent No.1/State may be directed to take a 3 decision on the recommendation made by the respondents No. 2 and 3 (Annexure P/9 and P/10) within a stipulated period. 4. Learned counsel for the State, though objected on merits, but he has no objection, if such a direction is to be given to the respondent No. 1 to take a decision on the recommendation made by the respondents No. 2 and 3. He would further submit that the respondent No. 1 will take a decision on the recommendation, if it is not already decided. 5. On due consideration and the submissions made by learned counsel for the petitioner and also under his limited prayer, the respondent No. 1 is directed to take a decision on the recommendation made by the respondents No. 2 and 3, dated 22.04.2024 and 13.06.2024 within 60 days from the date of receipt of the copy of this order, in accordance with law, on its own merits. 6. The petitioner is directed to produce a copy of this order within a week to the respondent No. 1. 7. With the aforesaid observation, the present petition is disposed of.
