This Writ Petition under Article 226 of the Constitution of India is filed for the following relief:
“to issue any writ order or direction more particularly one in the nature of writ of mandamus to declare the in action of the 4th respondent in not initiating investigation in Crime No.2 of 2019 though it was registered on 03.01.2019 even after a period 6 months as illegal arbitrary violation of Fundamental
2 right guaranteed under Article 21 of the Constitution of India and violation of Section 157, 167(2) and 173 of Cr.P.C and consequently direct the 3rd and 4th respondents to initiate investigation in Crime No.2 of 2019 dated 03.01.2019 and to grant and pass such…”
2. Learned Additional Government Pleader representing the State is in attendance.
3. None appeared for the petitioner, though the matter is posted under the caption “for dismissal”. There was no representation on behalf of the petitioner either physically or through Video Conference today, as well as on the previous adjournment.
4. In that view of the matter, the Writ Petition is dismissed for non-prosecution. There shall be no order as to costs.
As a sequel thereto, the interlocutory applications, if any, pending in this Writ Petition shall stand closed.
