Ajay Mohan Goel, Judge (Oral) By way of these petitions, the petitioners have, inter alia, prayed for the following relief:- “CMPMO No.379 of 2020 It is, therefore, respectfully prayed that the present petition may kindly be allowed and the impugned judgment dated 24.07.2020 passed by the Ld. Additional District Judge, Sundernagar, District Mandi, in Civil Misc. Appeal No.11/2020, whereby the common order dated 19.02.2020 passed by the Ld. Senior Civil Judge, Court No.1, Sundernagar, in CMA No.239 VI2019, in Civil Suit 1 Whether reporters of the local papers may be allowed to see the judgment? 2 2025:HHC:28660 No.86/1 of 2019 has been affirmed may kindly be set aside and further permitting the petitioners/ defendants to place the better material contained in Annexure P-5 before the competent court this matter may kindly be ordered to be remanded back with direction to the concerned court to take cognizance of the better material in the interest of justice. CMPMO No.380 of 2020 It is, therefore, respectfully prayed that the present petition may kindly be allowed and the impugned judgment dated 24.07.2020 passed by the Ld. Additional District Judge, Sundernagar, in CMA No.166-VI/2019, in Civil Suit No.86/1 of 2019 has been affirmed may kindly be set aside and further permitting the petitioners/ defendants to place the better material contained in Annexure P-5 before the competent court this matter may kindly be ordered to be remanded back with direction to the concerned court to take cognizance of the better material in the interest of justice.” 2. When these matters were taken up by the first time in this Court on 25.09.2020, the following order was passed:- “Issue notice returnable for 16.10.2020, on taking steps within one week. CMP No.9742 of 2020 Notice in the aforesaid terms. Reply, if any on or before the next date of hearing. In the meantime, further proceedings in Civil Suit No.86-1/2019 titled Saju Ram vs. Amar Singh and Ors. Shall remain stayed, till further orders. Copy dasti.” Thereafter, the Court stands informed that the civil suit stands 3 2025:HHC:28660 stayed. 3. Having heard learned Counsel for the parties and taking into consideration the fact that as on account of the stay granted by this Court on 25.09.2020, the proceedings in the civil suit have been standard for almost five years now, these petitions are disposed of by ordering and observing that let the parties maintain status-quo, qua the suit land as it is today and in the meanwhile, the interim granted by this Court is vacated forth-with and learned Court below is called upon to make an endeavour to decide the civil suit as expeditiously as possible. It is observed that not more than three opportunities shall be given to any of the parties to lead evidence and in case either of the parties makes any endeavour to un-necessarily create any hindered in the course of the adjudication of the case, then the other party shall be at liberty to move an appropriate application in these proceedings itself to bring this fact into the notice of the Court.
