(2) Since common questions of fact and law are involved in both the writ petitions, therefore, these are being heard and decided together by this common judgment. However, for brevity, facts of Writ Petition (S/ S) No. 1720 of 2025 alone are being considered and discussed here. (3) Petitioner was an employee of District Medicinal Herb Cooperative Federation, who retired on 31.3.2024 from the post of Storekeeper. Since his retiral dues have not been released so far, therefore, he has approached this Court seeking the following relief: “I. Issue a writ, order or direction in the nature mandamus directing the respondents to grant/ release monthly pension, gratuity, Encashment of Earned Leave, tim e scale pay and Modified Assured Career Progression, to the petitioner from the date of his retirem ent i.e. 31.03.2024 with penal interest.” (4) Learned Counsel for the petitioner refers to a letter dated 24.6.2025, issued by Secretary of the Federation to the Registrar/ Chief Executive Officer, Medicinal Herb Development Unit, Dehradun. By the 2025:UHC:9762 said letter, approval of the Registrar was sought to release the retiral dues by encashing the fixed deposits. (5) Learned State Counsel submits that since petitioner was an employee of Cooperative Federation and he was not a government servant, therefore, the State Government is not liable to pay anything to the petitioner. (6) Having regard to the facts and circumstances of the case and also in view of the letter dated 24.6.2025, issued by respondent no. 4, writ petitions are disposed of with a direction to Registrar/ Chief Executive Officer (respondent no. 3) to consider petitioner’s representation dated 14.10.2024 and pass necessary order, as per law, within three months from the date of presentation of certified copy of this order.
