ORAL ORDER Accused No.1 in S.C.No.1607/2024 pending before the Court of LXVI Additional City Civil and Sessions Judge, Bengaluru, arising out of Crime No.83/2018 registered by R.T.Nagar Police Station, Bengaluru for the offence punishable under Section 397 read with Section 34 of IPC is before this Court under Section 483 of BNSS, 2023, seeking regular bail.
2. Heard the learned counsel for the parties.

Learned counsel for the petitioner submits that on the merits of the case, the petitioner was granted regular bail earlier. For the reason that he has not appeared before the Trial Court on the dates of hearing, coercive action has been taken against him and his presence was secured on 13.12.2024 and on the said date, he has been remanded to Judicial Custody. The petitioner has no other criminal antecedents. Accordingly, he prays to allow the petition.
4. Per contra, learned HCGP who has opposed the petition, does not dispute the submission made by the learned counsel for the petitioner.

The perusal of the material on record shows that on the merits of the case, the petitioner was earlier granted regular bail and for the reason that he had absented himself before the Trial Court on the regular dates of hearing, a split-up case was registered against him in S.C.No.1607/2024 and in the said case, coercive action was taken to secure his presence and on 13.12.2024 his presence was secured and on the said date, he was remanded to judicial custody. It is not in dispute that the petitioner has no criminal antecedents. Considering the nature of allegations found against the accused in the charge sheet and also taking into consideration that the petitioner has been sufficiently punished for the mistake committed by him. I am of the opinion that the prayer made by the petitioner for grant of regular bail is required to be answered affirmatively. Accordingly, the following:-
ORDER
The petition is allowed. The petitioner is directed to be enlarged on bail in S.C.No.1607/2024 pending before the Court of LXVI Additional City Civil and Sessions Judge, Bengaluru, arising out of Crime

No.83/2018 registered by R.T.Nagar Police Station, Bengaluru for the offence punishable under Section 392 read with Section 34 of IPC, subject to the following conditions: a) The petitioner shall execute a personal bond for a sum of Rs.1,00,000/- (Rupees One Lakh only) with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is disposed off.
