HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW MATTERS UNDER ARTICLE 227 No. - 5586 of 2025 Court No. - 30 HON'BLE MANJIVE SHUKLA, J.
1. Heard Shri Angrej Nath Shukla, learned counsel appearing for the petitioner and learned State Counsel appearing for Respondent No.1. 2. In view of the order proposed, notice to Respondent No.2 is hereby dispensed with. 3. The instant petition has been filed by the petitioner, inter alia praying therein for the following relief:
"(a) to issue direction to opposite party no-1 to decide the application dated 17.10.2023, filed by the petitioner for disposal of objection against order dated 20.08.2019 passed in Case No.414/18/19, under section-9A(2) of Consolidation of Holdings Act situated in Village- Tulsipur, Pargana- Nababganj, Tehsil-Tarabganj, District-Gonda, Deenanath Vs State. (b) to issue direction in any nature which this Hon'ble court may deem fit and proper under the circumstances of the case. (c) Allow the petition with cost in favour of petitioner."
4. It has been contended on behalf of the petitioner that a case filed under Section 9(A)2 of the U.P. Consolidation of Holdings Act, 1953 had been decided by the Respondent No.1 vide order dated 20.08.2019. The petitioner has filed an application for recall of the order dated 20.08.2019 on 17.10.2023 but the said application is pending before Respondent No.1 and has not been decided till date. Versus Counsel for Petitioner(s) : Angrej Nath Shukla Counsel for Respondent(s) : C.S.C. Sripati .....Petitioner(s) Consolidation Officer, Old Gonda And Anr. .....Respondent(s)
5. Learned Standing Counsel, on the other hand, has very fairly submitted that the ends of justice would be served, if a direction is issued by this Court thereby commanding Respondent No.1 to consider and decide the application in question, expeditiously, within the time frame fixed by this Court. 6. I have considered the arguments advanced by learned counsels for the parties and I find that the application filed by the petitioner is pending before Respondent No.1 since 17.10.2023. 7. In view of the aforesaid reasons, this petition is finally disposed of with a direction to Respondent No.1, i.e., Consolidation Officer, Gonda, to consider and decide the application filed in Case No.414/18/19, under section-9A(2) of Consolidation of Holdings Act, expeditiously, preferably within a period of six months from the date of presentation of certified copy of this order before him, provided that there is no legal impediment. 8.
Needless to say that this Court has not adjudicated upon merits of the case. September 17, 2025 V. Sinha A227 No. 5586 of 2025 2 (Manjive Shukla,J.) Digitally signed by :- VAISHALI SINHA High Court of Judicature at Allahabad, Lucknow Bench
