1.PUBLIC PROSECUTOR The Court made the fo[Iowjnc] Order:- The Criminal Petition, under Section 482 of the BNSS, is filed on behalf of the petitioners herein/Al to A4 to grant anticipatory bail in connection with Crime No.202 of 2022 of Special Enforcement Bureau Station, Banaganapalle, KurnooI District, registered for the offences punishable under Sections 7(A) r/w 8(e) of the A. P. Prohibition (Amendment) Act, 2020 and Section 13(b) of the A.P. Prohibition (Amendment) Act, 2020. / 2

2. Brief facts of the case are that, on o1.06.2022, the Enforcement Inspector, along with his staff proceeded to Mangampeta village and found four male persons and one female person whI'le they Were preparing ID liquor. On seeing the police party, the accused escaped from the scene of offence. The Enforcement Inspector verified the place and found 600 liters of FJ wash and found 20 lI'terS Of lD liquor. The contraband was seized under the cover of special report and a case was registered against the petitioners. 3. Heard. Perused the record. 4. Learned counsel for the petitioners contends that although the incident in question is said to have occurred on o1.06.2022 and the names of the petitioners are mentioned in the FIR, the report does not clearly explain why the Investigation Officer failed to apprehend the accused persons at that time. Moreover, it is not clear from the record as to why they have not taken steps to effect the arrest of the petitioners ever after expiry of 2 1/2 years. 5. Learned Assistant Public Prosecutor vehemently opposed to grant anticipatory bail to the petI'tiOnere` and submitted that the petitioners herein have no previous crime record. 6. The ,further submission of the learned counsel for the petitioners is that they have a permanent place of residence, which is not in dispute. ln view of the said fact, there is no valid reason provided by the Investigating Officer for effecting their arrest. lt submitted by the learned counsel for the petitioners that most of the witnesses are official witnesses and granting of antI'CiPatOry bail to the petitioners would not hamper the investigation. 7. ln view of{he facts and circumstances of the case, this court is inclined to grant an{icipatory bail to the petitioners herein, on the following conditions. a-. -, EL-.,'- ..... - ----- -i _ &, u¢. £deth` ` _;_i a 3 (i) The petitioners herein are directed tO Surrender before the station House Officer concerned, within a Period Of two (2) weeks from the date of receipt of a copy of this order. On such surrender, the petitioners herein are ordered to be enlarged on bail on their executing a persohal bond for Rs.10,000/-(Rupees ten thousand only) each with one surety for the like sum each to the satisfaction of the station House Officer concerned.
(ii) The petitioners shall make themselves available for investigation as and when required and that they shall not cause any threat, inducement or promise to the prosecution witnesses. 8.
