Heard learned counsel for the applicant, learned AGA for the State of U.P. and perused the record. The instant application has been preferred for the following main relief:- "It is, therefore, most respectfully prayed that this Hon'ble Court may graciously be pleased to allow the instant Application under Section 529 BNSS, 2023 whereby directing The Learned Court of Additional Court No.9(N.I. Act), Lucknow, District- Lucknow, to decide the entire proceedings of the Complaint Case bearing Criminal Case No. 75997/2021 (CNR No. UPLK040925202021), U/s- 138/142 N.I. Act, 1881, (Shashikant Gupta Versus Pankaj Gupta), Police Station- Bakshi Ka Talab, District- Lucknow, pending before him, expeditiously as early as possible, in the interest of justice." Considering the facts and circumstances of the case as also that the complaint case in issue is pending consideration since 2021 before the trial court concerned and as per Section 143 of the Negotiable Instruments Act, 1881, case instituted under Section 138 of the Act of 1881 shall be concluded expeditiously as possible and an endeavour shall be made to conclude the trial within six months from the date of filing of the complaint, the present application is disposed of with a direction to the court concerned to decide the case in issue, expeditiously. With the aforesaid, the instant application is disposed of.
