Heard learned counsel for the applicants, learned A.G.A. for the State and perused the record. The instant application has been filed seeking following main relief(s) :- "WHEREFORE, it is most respectfully prayed that this Hon'ble Court may kindly be pleased to set-aside the entire proceedings of impugned order dated 09.07.2025 passed by Judicial Magistrate III, Lucknow in Complaint Case No. 3829/2023, Under Section 12 of Domestic Violence Act, Police Station- Sarojani Nagar, District- Lucknow by which the learned Magistrate passed the order in most illegal and arbitrary manner without applying judicial mind. contained as Annexure No. 1 to the petition, so for it relates to the petitioners. It is further prayed that this Hon'ble Court may kindly be pleased to stay the entire proceedings of impugned order dated 09.07.2025 passed by Judicial Magistrate III, Lucknow in Complaint Case No. 3829/2023, Under Section 12 of Domestic Violence Act, Police Station Sarojani Nagar, District- Lucknow by which the learned Magistrate passed the order in most illegal and arbitrary manner without applying judicial mind contained as Annexure No. 1 to the petition, so for it relates to the Versus Counsel for Applicant(s) : Surya Kumar Counsel for Opposite Party(s) : G.A. Smt. Usha Rani And 2 Others .....Applicant(s) State Of U.P. Thru. Secy. Home U.P. Lko. And Another .....Opposite Party(s) petitioners, in the interest of justice." On account of some formal defects crept in the application, learned counsel for the applicants prays for withdrawal of the present application with liberty to the applicant to file afresh with proper pleadings and documents in support thereof. The aforesaid has not been opposed. In view of the above, the instant application is dismissed as withdrawn with liberty as prayed for. Office is directed to return certified/original copies of the documents annexed with the application to the learned counsel for the applicants as per rules.
