The applicant has preferred this application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’), for grant of anticipatory bail, apprehending his arrest in connection with Crime No.112/2024, registered at Police Station Purur, District Balod (C.G.) 2 for alleged commission of offence punishable under Section 20(B) of NDPS Act.
3. Case of the prosecution, in brief, is that on 24/09/2024 after receiving information that one silver colour Bolero vehicle bearing no. MP-04-BA- 1911 in which two people were travelling were carrying narcotic substance Ganja and traveling from Malkangiri Odisha to Raipur, the vehicle was stopped and Saddu Khan S/o Sarfulla Khan and Dilip Kumar S/o Nathuni Yadav were arrested and upon investigation it was revealed that they were taking Ganja from Malkangiri Odisha to deliver it to Arjun Singh at Buxar, Bihar. The police team took action under the NDPS Act and seized the contraband article 74 kilograms of ganja along with a silver-colored Mahindra Bolero vehicle from the accused's possession.

Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated in the present case. He would submit that FIR was registered against Arjun Singh, but police has ultimately filed charge sheet against present applicant Ajeet Kumar Singh. He would submit that brother of the applicant namely Amit Kumar Singh has also filed complaint before the Superintendent of Police Balod and Inspector General of Police, Durg Range alleging that applicant is being falsely made accused in the present case. Learned counsel for the applicant vehemently disputes the identity as he is not the same person who is wanted in the present case. Therefore, he prays to enlarge the applicant on anticipatory bail.
5. On the other hand learned State counsel opposes the application for grant of anticipatory bail to the applicant.

6. Recently the Supreme Court in the matter of Anarul SK v. The State of West Bengal {SLP (Crl.) No(s). 12621/2024 has observed that the grant of anticipatory bail in cases involving Narcotic Drugs and Psychotropic Substances (NDPS) is a very serious issue.
7. In the light of observation made by the Supreme Court in Anarul SK (supra), I do not find any good ground to entertain this anticipatory bail application. Accordingly, the present anticipatory bail application is dismissed. Sd/- Sd/-
