Pakur, P.S.- Pakur (Town), District- Pakur (Jharkhand). ... Respondents --------- CORAM: HON’BLE THE CHIEF JUSTICE HON’BLE MR. JUSTICE RAJESH SHANKAR --------- For the Petitioner : Mr. Rakesh Sharma, Advocate. For the Respondents : Mr. Sahbaj Akhtar, AC to AAG-III --------- 13/Dated: 26.08.2025 1. On 11.06.2025, this Court passed the following orders:- “1) Report filed by the State Government is taken on record. Counsel for the petitioner seeks to verify whether water supply through the tankers is being made in the area or not. 2). List on 02.07.2025.” 2. Thereafter, when the case was taken up on 02.07.2025, the Court passed the following orders:- “1. Counsel for the petitioner shall obtain an affidavit from the petitioner with regard to the water supply through the tankers in the area in question in the light of the supplementary counter affidavit filed by the respondents. 2. List on 12th August, 2025.” 2025:JHHC:25655-DB -2 of 2- 3. The petitioner has failed to comply with both the aforesaid orders and as per the counsel representing him, the petitioner has failed to impart instructions given the fact that various orders have already been passed by this Court with regard to the supply of potable water to the inhabitants of Pakur Nagar Parishad. 4. We are quite sure that the petition has achieved its purpose, in view of the various directions that have been passed from time to time and this is the precise reason why the petitioner is not imparting instructions to his counsel hence, we see no reason to keep it alive. 5. However, before parting we make it absolutely clear that since a fresh work order for “remaining work of Pakur Urban Water Supply Scheme under Drinking Water and Sanitation Division, Pakur on Turnkey Basis for the year 2024-25” has been issued on 22nd August, 2025 and the time period specified therein is six months including the testing etc., we hope and trust that the said work would be completed within the time stipulated as per the work contract, and in case the same is not done, obviously the petitioner or any person affected would be at liberty to have the petition revived. 6. Accordingly, this W.P. (PIL) is disposed of with the liberty as aforesaid. (Tarlok Singh Chauhan, C.J.) (Rajesh Shankar, J.) N.A.F.R. APK/VK
