The present application under Section 528 of Bharatiya Nagarik Suraksha Sanhita has been filed to quash the order dated 08.11.2024 passed by Additional Principal Judge, Family Court, Aligarh in recall/ restoration application in Criminal Misc. Case No. 2782 of 2024 to restore its original number and to quash the ex-parte order dated 09.05.2022 passed in Maintenance Case No. 578 of 2019 arising out of an application under Section 125 of Cr.P.C. whereby the application on condonation of delay is dismissed. After some arguments, learned counsel for the applicant does not want to press this application and wants liberty to file an appropriate application/ proceedings before the court of competent jurisdiction. Certified copy of the order may be returned to the learned counsel for the applicant after retaining a xerox thereof.
