Hon’ble Ravindra Maithani, J. (Oral) By means of the instant application, the applicant seeks transfer of Original Suit No. 224 of 2023, Shri Brijpal Singh Verma v. Smt. Jyoti, (“the case”) pending in the court of Additional Family Judge, Family Court, Rishikesh, District Dehradun. 2. Heard learned counsel for the parties and perused the record. 3. The applicant is the wife of the respondent. Both the applicant and the respondents were married on 06.06.2010. Thereafter, dispute arose in the relationship. The case has been for divorce by the respondent. The applicant seeks transfer of the case from the court of Additional Family Judge, Family Court, Rishikesh, District Dehradun to the court of Judge, Family Court, Kashipur, District Udham Singh Nagar. 4. Learned counsel for the applicant submits that the applicant is the resident of Jaspur; it may be inconvenient to her to travel to Rishikesh to attend the proceedings of the case; therefore, the case may be transferred to the court of Judge, Family Court, Kashipur, District Udham Singh Nagar. 2 5. Learned counsel for the respondent submits that he has no objection to it. He submits that the respondent is critically ill and, therefore, the court may be directed to decide the case, as expeditiously as possible. 6. Having considered, the transfer application is allowed. 7. The Original Suit No. 224 of 2023, Shri Brijpal Singh Verma v. Smt. Jyoti, is transferred from the court of Additional Family Judge, Family Court, Rishikesh, District Dehradun to the court of Judge, Family Court, Kashipur, District Udham Singh Nagar. 8. The Court requests the Judge, Family Court, Kashipur to decide the case, as expeditiously as possible keeping in view the illness of the respondent.
