HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW MATTERS UNDER ARTICLE 227 No. - 5568 of 2025 Court No. - 30 HON'BLE MANJIVE SHUKLA, J. 1 . Heard learned counsel appearing for the petitioner and learned Standing Counsel appearing for Respondents No.1 and 2 and Sri Pankaj Gupta, learned counsel appearing for Respondent No. 6. 2. In view of the order proposed, notice to Respondents No. 3 to 5 is dispensed with. 3. The captioned writ petition has been filed by the petitioner interalia praying therein for the following main relief:-
" i. It is most respectfully prayed that this Hon'ble Court may graciously be pleased to allow the instant petition U/A-227 of the Constitution of India by directing the opp party no. 1 to decide the Revision case no. 164/2024 (Computerised Case no. C202408000000164) "Harishchandra Vs. Jumai And others filed U/s 333, U.P. Z. AL R. Act, 1950, which is pending before the opp party no.1 expeditiously as early as possible, in the interest of justice.."
4. It has been contended on behalf of the petitioner that a revision under Section 333 of the U.P. Z. A. & L. R. Act, 1950, was filed by the petitioner in the year 2024 and since then the same is pending and has not been decided. 5. Learned counsel appearing for the petitioner has argued that in view of the provisions made in sub-clause 2 of the Paragraph 458 of the U.P. Revenue Court Manual, it is obligatory on the Respondent No. 1 to hear and decide the appeal or revision within a period of six months. Versus Counsel for Petitioner(s ) : Rahul Kumar Shukla, Mohit Singh, Shivam Srivastava Counsel for Respondent(s ) : C.S.C., Pankaj Gupta Harishchandra .....Petitioner(s) Commissioner, Division Devi Patan, Gonda And Others .....Respondent(s)
6. Learned Standing Counsel appearing for the State-Respondents and Sri Sri Pankaj Gupta, learned counsel appearing for Respondent No. 6 do not have any objection, if a direction issued by this Court commanding the Respondent No. 1 to hear and decide the petitioner's revision within a time frame fixed by this Court. 7. I have considered the submissions advanced by the learned counsel for the parties and I find that a revision under Section 333 of the U.P. Z. A. & L R. Act, 1950 is pending before Respondent No. 1 since 2024.
I further find that the sub-clause 2 of the Paragraph 458 of the U.P. Revenue Court Manual provides that any appeal or revision is to be decided within a period of six months. 8. In view of the aforesaid reasons, this petition is finally disposed of with a direction to the Respondent No. 1 to hear and decide the Revision Case No. 164/2024 (Computerised Case no. C202408000000164)
"Harishchandra Vs. Jumai And others filed U/s 333, U.P. Z. A. & L R. Act, 1950, expeditiously, preferably within a period of one year from the date of presentation of a certified copy of this order provided there is no legal impediment. September 16 , 2025 Anuj Singh A227 No. 5568 of 2025 2
