orders dated 08.09.2025 and 11.09.2025 passed by this Court in Criminal Misc. Bail Application Nos. 8471 of 2025 and 8450 of 2025. 7. Learned A.G.A. has vehemently opposed the bail application and he has submitted that a sword has been recovered and the applicant has stated that he had carried the sword for making the assault. However, the recovery memo states that the sword was recovered along with other articles from the boot of a Car and not from the possession of the applicant alone. 8.
Having considered the aforesaid facts and circumstances of the case and keeping in view the fact that the persons from both the sides have received injuries in the incident but there is no mention regarding the injuries suffered by persons from the applicant's side in the FIR which indicates that the FIR does not disclose the complete facts; all the injuries suffered in the incident were simple in nature; that the applicant has no previous criminal history and he is languishing in jail since 26.07.2025 and that two co-accused persons have already been granted bail, I am of the view that the applicant is also entitled to be released on bail on the ground of parity. 9. Accordingly, this bail application stands allowed. 10. Let the applicant- ParveJ be released on bail in the aforementioned case on furnishing a personal bond and two sureties each in the like amount to the satisfaction of Magistrate/Court concerned, subject to following conditions:- (i) the applicant shall not tamper with the prosecution evidence; (ii) the applicant shall not pressurize the prosecution witnesses; (iii) the applicant shall appear on each and every date fixed by the trial Court.
