For the State : Ms. Shweta Singh, A.P.P. ----- 09/ 17.04.2025 Heard the parties. 2. This anticipatory bail application under Section 438 and 440 of Criminal Procedure Code, has been preferred by the petitioner apprehending his arrest for offences under Section 379 of the Indian Penal Code, Sections-21 of the MMDR Act and 13 JM (PIMTS) Rule, 2017, in connection with Chandwa P.S. Case No. 48 of 2024, pending in the Court of learned A.C.J.M, Latehar. 3. Learned A.P.P. representing the State opposes the prayer for anticipatory bail. 4. It has been submitted that during the pendency of this case, the charge-sheet has already been submitted against the petitioner. 5. Once the charge-sheet has already been submitted, it is clear that the investigation has already been concluded. This also suggests that the petitioner had cooperated during investigation and it was not felt necessary to arrest the petitioner during investigation. Thus, no purpose would be served to take the petitioner in custody. 2025:JHHC:11661 2 6. Considering the aforesaid fact that charge-sheet has been submitted, this Anticipatory Bail Application stands allowed. The petitioner, above named, is directed to surrender before the learned court below within four weeks from the date of receipt of copy of this order and on the event of his surrender or arrest, he shall be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each, to the satisfaction of learned A.C.J.M, Latehar, in connection with Chandwa P.S. Case No.48 of 2024, subject to the condition that one of the bailers should be a close relative of the petitioner and other should be a resident of State of Jharkhand, having sufficient landed property in his name or in the name of his ancestors in which he is having share and to that effect, he has to file an affidavit before the Trial Court indicating his share in the property.
