Jyotsna Rewal Dua, J This writ petition has been filed for the grant of following substantive reliefs: - “(i) That writ of mandamus may kindly be issued, directing the respondents to issue NOC/Essential SSC Certificate in favour of the petitioner Society for running 60 seats of B.Sc. Nursing in M/s A-One Educational Society, Village Raja-ka-Bagh, P.O. Nagabari, Tehsil Nurpur, District Kangra, H.P., within a time bound manner in light of the judgment dated 10.11.2023 passed by this Hon'ble Court in CWP No. 4736/2023, titled as M/s Minerva College of Nursing v/s State of Himachal Pradesh & others (Annexure P-13), since the petitioner Society fulfills all the requisite criteria. 1 Whether reporters of the local papers may be allowed to see the judgment? yes 2 (ii) That writ of mandamus may kindly be issued, directing the respondent authorities to allot 60 seats of B.Sc. Nursing in the counselling to be held for session 2025-2026. 2. Learned counsel for the petitioner invited attention to office letter dated 14.03.2023 issued by respondent No.4, Director of Medical Education and Research, Himachal Pradesh, to respondent No.1, recommending petitioner’s case for B.Sc. (Nursing) for 40 seats. Petitioner’s grievance is that, despite the aforesaid recommendation made by respondent No.4, the competent authority i.e. respondent No.1 has till date, has not passed any order. Attention was also invited to the decision rendered in M/s Minerva College of Nursing Vs. State of H.P. & Ors.2 with the assertion that petitioner’s case for grant of No Objection for running the B.Sc. Nursing Course as recommended by respondent No.4, which in turn is based upon the instructions recommended by HPNRC, is squarely covered by the aforesaid decision. 3. Learned counsel for the petitioner submitted that the petitioner would be satisfied, if respondent No. 1/competent authority is directed to consider petitioner’s case for redressal of the grievance raised in the present petition, keeping in view the recommendations made by respondent No. 4, in terms of office letter dated 14.03.2023, inter alia, in light of the decision rendered in M/s Minerva College of 2 CWP No. 4736/2023 decided on 02.11.2023 3 Nursing2 and in accordance with law, within a time bound manner. Learned counsel for the respondents have no objection to this prayer. 4. Having regard to the above submissions, but without examining the merits of the matter, the instant writ petition is disposed of by directing respondent No. 1/competent authority to consider and decide petitioner’s grievance raised in this writ petition, in light of the recommendations made by respondent No. 4, in terms of the office letter dated 14.03.2023, taking into consideration the above judgment and in accordance with law, within a period of six weeks from today.
