Heard Sri P.Nagendra Reddy, learned counsel for the petitioner, Ms. K. Priyanka Lakshmi, learned Assistant Public Prosecutor for the State and Sri Kanderi Chethan, learned counsel appearing for the respondent No.2. Learned counsel would submit that basing on the information furnished by two persons as mentioned in the complaint, the de-facto complaint had given a complaint against the petitioner, which is not maintainable. Per contra, learned counsel for the respondent No.2 had vehemently opposed the petition and would submit that the Police after due investigation have filed the Charge Sheet and the learned V Additional Junior Civil Judge, Tirupathi, had taken cognizance of the offences punishable under Sections 447, 427 r/w 34 IPC, in relation to the case in C.C.1140 of 2023 against the petitioner and as such prays for dismissal of the criminal petition. 3. 4. Learned Assistant Public Prosecutor appearing for the State is in 5. attendance and supporting the case of the de-facto complainant. Considering the submissions made and a fair look at the material on record, which would should that a prima facie material is there against the petitioner to attract the offences alleged i.e., for the trespass and the damage 6. and the matter requires investigation at the full length of trial as the Trial Court had taken cognizance of the offences against the petitioner. In that view, the Criminal Petition is dismissed. However, the petitioner 7. is at liberty to raise all the contentions before the Trial Court and the learned Trial Judge may appreciate the same and take appropriate decision in accordance with law.
