None present for the parties. 2. Petitioner is serving as Deputy Manager in National Fertilizers Ltd. On 24.02.2023, he was transferred from SO Bareilly (Uttar Pradesh) to SMP Kichha (Uttarakhand). Before he could complete three years at Kichha (Uttarakhand), he was again transferred to Gaya (Bihar) as Area Officer on 15.12.2023. Thus, feeling aggrieved by his transfer, petitioner approached this Court challenging his transfer to Gaya (Bihar). 3. It is contended that transfer order is passed in violation of the Policy applicable in the National Fertilizers Ltd.; petitioner is due to retire next year, therefore, disturbing him by transferring to Gaya (Bihar) at the fag end of his service career is against all settled canon of fair play in action. 4. Coordinate Bench, vide order dated 11.01.2024 granted interim order in favour of petitioner. Since petitioner has less than a year left for his superannuation and reportedly there is a Policy in National Fertilizers Ltd. not to disturb Officer/ Employees at the fag end of their service career, therefore, the writ petition is disposed of with liberty to petitioner to make representation to the Competent Authority against his transfer. If petitioner makes representation to the Competent Authority within three weeks from today, the Competent Authority 2025:UHC:10267 shall take decision thereupon within three months thereafter. For a period of four months or till decision is taken by the Competent Authority, whichever is earlier, status quo as regards petitioner’s posting shall be maintained.
