Sahewalla, learned Senior Counsel assisted by Mr. M. Sahewalla, learned counsel for the petitioner. Also heard Mr. D. Saikia, learned Senior Counsel assisted by Mr. P. Nayak, learned counsel for the respondents. By filing this writ petition, the petitioner essentially has put to challenge the order dated 05.07.2025, issued by the respondent authorities, whereby the contract bearing No. 6120002/CDG5545P24/DRLG/24 for “Charter Hire of 01 (One) number of 2000 HP [minimum] drilling rig package” has been terminated with effect from 21.06.2025, and the consequential letter dated 07.07.2025 directing vacation of the allocated present drilling location-BJA. Considering that the parties have entered into a form of settlement on revisiting the dispute on the basis of the representation dated 06.08.2025, and as agreed to by the learned Senior Counsel for the parties, this writ petition is disposed of at the motion stage with the following observations: (i) Since the petitioner has intimated the respondent authorities by e-mail dated 13.06.2025 that the rig package has been prepared for spudding and accordingly requested for inspection and assessment of rig readiness, to which the respondent authority inspected and furnished a certain observation to the petitioner requesting for necessary Page No.# 3/3 corrective measures, and the petitioner is ready to complete the spudding, same shall be allowed to be carried out. (ii) As on date, as the rig is ready to start the operation, few equipments which are not as per the terms and conditions of the agreement shall be made available within a week. Discrepancies as observed in the documentation shall be rectified prior to the commencement of the operation. (iii) The petitioner has also undertaken to pay liquidated damages as per the contract agreement as enshrined in Clause 30.0. The writ petition accordingly stands disposed of.
