CORAM :
SRI ANANDA SEN, J. ------ For the Petitioner(s) : M/s Sheo Kumar Singh and Raj Nandan Chatterjee and Nishad Khan, Advocate. For the State : Mr. Prabhu Dayal Agrawal, A.P.P. …..... 03/10.07.2025: This anticipatory bail application under Section(s) 482 and 484 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, has been preferred by the petitioner apprehending his arrest for the offences registered under Section(s) 279/272/273 IPC and Section(s) 47(a) of the Excise Act, in connection with Barkatha P.S. Case No. 02/2019, pending in the Court of learned Judicial Magistrate, 1st Class, Hazaribag. Heard the parties at length and had gone through the documents, annexed along with this application. Opportunity was given to the State to oppose the bail, which the State availed and opposed. It is alleged that in the vehicle of the petitioner, spirit was being transported.
Learned counsel for the petitioner submits that the petitioner has appeared before the police. The petitioner admitted before the police that he had purchased the vehicle. Learned A.P.P submits that there are four criminal cases, except this one, pending against the petitioner in the State of Bihar, which are as follows:- Gurua P.S. Case No. 87/2021 dated 10.4.2021 (District- Gaya), Bihar. Amba P.S. Case No. 34/2021 dated 24.3.2021 (District- Aurangabad), Bihar. Amba P.S. Case No. 39 of 2024 dated 17.10.2024 (District- Aurangabad), Bihar. Amas P.S. Case No. 08/2024 dated 6.1.2024 (District- Gaya), Bihar. Considering the criminal antecedent of the petitioner, this is not a fit case to grant anticipatory bail to him. Accordingly, the prayer for bail of the petitioner, above named, is rejected.
