The applicant has preferred this application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS'), for grant of anticipatory bail, apprehending his arrest in connection with Crime No.05/2025, registered at Police Station Shivrinarayan, District Janjgir- GOURI MUDALIAR Digitally signed by GOURI MUDALIAR Date: 2025.04.09 11:34:39 +0530 2 Champa (C.G.) for alleged commission of offence punishable under Sections 420, 34 of the Indian Penal Code. 3. Case of the prosecution, in brief, is that the applicant is alleged to be the holder of a Bank account in which the complainant has given amount of Rs. 2,00,000/- to the applicant for providing the job for the post of Zone Commissioner at Municipal Corporation Bilaspur and on account of that, the applicant's son has issued forged appointment to the complainant. Based upon such complaint made by the complainant, the concerned police station has registered the offence under section 420, 34 of the Indian Penal Code against the applicant. 4. Learned counsel for the applicant submits that the applicant is innocent and falsely implicated in the instant case. He would submit that the applicant has not obtained any amount from the complainant for providing job. He would further submit that the applicant is permanent resident of Kera Road Para, Atal Chowk, Mudpar, Post Kansada, Tahsil Nawagarh, Up District Nawagarh, District Janjgir-Champa and there is no likelihood of his absconding. Hence he prays to enlarge the applicant on anticipatory bail. 5. On the other hand, learned State counsel opposes the prayer for grant of anticipatory bail. 6. I have heard learned counsel for the parties and perused the case diary. 7. Taking into consideration the nature of allegation made against the present applicant that he received amount of Rs. 2,00,000/- in his bank account from the complainant for providing job for the post of Zone Commissioner at Municipal Corporation Bilaspur and the applicant's son has issued forged appointment letter to the complainant, I am not inclined to grant anticipatory bail to the applicant. 8. Accordingly, the anticipatory bail application of the applicant Mansharam 3 Ashikar, involved in Crime No.05/2025, registered at Police Station Shivrinarayan, District Janjgir-Champa (C.G.) for alleged commission of offence punishable under Section 420, 34 of the Indian Penal Code is rejected.
