Heard Mr. S. Sinha, the learned counsel appearing on behalf of the petitioner and Mr. S. Bora, the learned Standing counsel appearing on behalf of the respondent Nos. 1, 2 and 3.
2. Taking into account the order which this Court proposes to pass at this stage, this Court is of the opinion that the notice as regards the respondent No.4 can be dispensed with.
3. The petitioner herein is aggrieved by the non-disposal of the appeal which was filed on 06.09.2024 before the Appeal Committee of the Guwahati Municipal Corporation. The said appeal has been registered as GCL No. 31/2024.
4. This Court enquired with the learned Standing counsel appearing on behalf of the Guwahati Municipal Corporation as to why the appeal has not been disposed of. The learned Standing counsel submitted that if a direction is passed, the said appeal can be disposed of at the earliest.
5. This Court further takes note of that on account of the order which has been impugned in the appeal proceedings, the petitioner is not in a position to carry out any business which is affecting his rights under Article 19(1)(g) of the Constitution. Accordingly, this Court is of the opinion that the Appeal Committee of the Guwahati Municipal Corporation is required to dispose of the appeal at the earliest and preferably within 15 days from the date a certified copy of the instant
order is served upon the Commissioner, GMC who shall duly instruct the
Page No.# 3/3 Appeal Committee to dispose of the appeal at the earliest as directed above.
6. With above observations and directions, the instant writ petition stands disposed of.
