By the present writ petition, the petitioner, who is retired Administrative Officer of the Municipal Corporation, Chirmiri seeking a limited direction towards the respondent No.2 to release the undisputed retiral dues of the petitioner as the petitioner has retired on 30/04/2020 as the entire retiral dues has ben with held on the ground that some judicial proceeding is pending against the petitioner. 2. Learned counsel for the petitioner submits that the entire retiral dues i.e. leave encashment, gratuity cannot be with held on the ground of pendency of judicial proceedings, hence, the respondents be directed to consider the representation submitted by the petitioner. 3. Learned counsel for the State/respondents submit that if the representation claiming the retiral dues of the petitioner is pending before the respondent No.2, the same shall be considered in accordance with law within a stipulated period. 3 4. I have heard learned counsel for the parties, perused the pleadings and documents. 5. Looking to the fact that the petitioner has been retired from the service in the year 2020, the writ petition is disposed of with a direction to the respondent No.2 to decide the representation filed by the petitioner within a period of forty days from the date of receipt of copy of this order. 6.
