This is an application under Section 482 BNSS, 2023 praying for grant of pre-arrest bail to the petitioner in connection with Bilasipara P.S. Case No. 196/2025 under Sections 296/75/351(2) of the BNS, 2023 R/W Section 10/12 of the POCSO Act. 3. The brief of the case is that on 14/06/2025 one Bulbuli Bibi, W/O- Sahanur Hoque, resident of Village-Bangalipara Pt 1(Eluartari), P.O. & P.S.- Bilasipara, Dist- Dhubri, Assam lodged an ejahar before the Officer-in-Charge of Bilasipara Police Station alleging, inter alia, that one Gajiur Rahman, School teacher of Dr. APJ Abdul Kalam Academy at Surjyakhata, Bilasipara, started giving proposal to her minor daughter namely xxx xxx aged about 16 years since Sept 2024 when she was studying at class 10 at the said school, to make relationship with him, used to send obscene videos and messages in her mobile being 7896565356 from his mob No. 7002843462, tried to bring her to the market and hotel rooms, threatened her about destroying her life if she doesn't make relationship with him also blackmailed not providing pass marks in practical exam if she does not make physical relationship with him going to the hotels, touched her calling her at the office room when she was alone, proposed her to go to hotel rooms and make physical relationship with him since long back and also threatened her of killing if she reveal it to her parents and relatives, being unable to bear all these mental torture when she told her phone he got angry and gave threatening of killing of all her family members and destroy her daughter's life by defaming her in society in front of her niece namely Sahanas Begum, D/O- Shahidul Hoque when she went to her tuition at Surjyakhata at around 11:30 AM today on 14/06/2025. It is submitted on behalf of the petitioner that this Case is a counter-blast to the previous FIR lodged by the petitioner against the present complainant side on account of assault inflicted upon him causing serious injuries on the basis of which Bilasipara PS Case No. 195/2025 was registered. 5. The Case Diaries of both the cases have been received. 6. I have perused the statement of the alleged victim which contains materials of gravely incriminating nature. It also appears from the Case Diary of Bilasipara PS Case No. 195/2025 that the alleged assault upon the petitioner took place on account of his alleged harassment of the victim. 7. Considering the incriminating material and nature of the allegations, I do not consider the present to be a fit case for grant of pre-arrest bail. 8. Accordingly, the prayer stands rejected.
