Applicant Sangeet is in judicial custody in Case Crime No. 09 of 2025, under Section 8/21/29 of the Narcotic Drugs and Psychotropic Substances Act, 1985, Police Station Shyampur, District Haridwr. He has sought his release on bail.

Heard learned counsel for the parties and perused the record.

According to the FIR, on 11.01.2025, the applicant and the co-accused were spotted together at an isolated place and from the possession of the co-accused, 167 gms. Smack was recovered.

State was required to file objections. He would submit that, in fact, instructions were sought.

Learned counsel for the applicant would submit that nothing was recovered from the applicant; he has not
2 committed any offence; the applicant is not a previous convict.

Learned State Counsel admits that the recovery was made from the co-accused. But, he would submit that the applicant was spotted with the co-accused.

Having considered, this Court is of the view that it is a case fit for bail and the applicant deserves to be enlarged on bail.

The bail application is allowed.

Let the applicant be released on bail, on his executing a personal bond and furnishing two reliable sureties, each of the like amount, to the satisfaction of the court concerned.
