For the petitioner : Mr. Sanjeev Kuthiala, Senior Advocate, with Ms. Sana Rana, Advocate. For the respondents : Mr. Pushpinder Jaswal, Additional Advocate General, for the respondent- State. Ajay Mohan Goel, Judge (Oral) Learned Senior Counsel, appearing for the petitioner, on instructions, submits that the petitioner be allowed to withdraw this petition, as he intends to pursue his legal remedy before the Civil Court and he also intends to withdraw the revisional proceedings which have been preferred before the Revenue Authorities. He further submits that it be observed that in the event of any Civil Suit being filed alongwith an application under Section 14 of the Limitation Act, then the same be considered sympathetically.
2. The petition is allowed to be withdrawn, with liberty, as prayed for. As far as the other request made by learned Senior 1 Whether reporters of the local papers may be allowed to see the judgment?
2 2025:HHC:19413 Counsel is concerned, all that this Court can observe is that if any such application is filed, then learned Civil Court concerned may adjudicate the same taking into consideration the factum of the petitioner pursuing the remedy before the Revenue Authority, of course in accordance with law, subject to the rights of the other parties. Further, the petitioners are always at liberty to withdraw the proceedings which they have initiated before the Revenue Authorities, if so advised
3. The petition stands disposed of. Pending miscellaneous application(s), if any also stand disposed of accordingly.
