2. By this application, the petitioner has prayed for pre-arrest bail in connection with Bokakhat P.S. Case No. 82/2025 registered under Section 316(2)/318(2) and 316(5) of BNS, 2023. 3. The FIR dated 14.07.2025 reflects that the President of an Organization, namely Bharati Rindan Samabai Samity Ltd. Bokakhat had misappropriated the hard-earned money from the poor daily wage earners and that the misappropriation reaches to the tune of Rs. 150 Crore. 4. Mr. J.C. Gogoi, learned counsel for the petitioner submits that the petitioner was the Secretary of the said Samity but he has no connection with the said offence. He rather submits that the petitioner resign from the post of Secretary and after his resignation, he lodged the complaint about the misappropriation done by the President of the said Samity, which was enquired and an enquiry report was submitted, wherein it was reflected that the President was involved in the entire offence of misappropriation. 5. Ms. S.H. Borah, learned Add. Public Prosecutor for the State respondent submits on perusal of the Case Diary that the President of the said Samity is actually involved in the said offence, which was stated by the President himself in his statement before the Police and that no other persons were involved in the offence. 6. It is also noticed that the petitioner was enlarged on interim pre-arrest bail vide Order dated 28.07.2025 and in compliance of the conditions mentioned therein, the petitioner had co-operated with the investigation and had appeared before the Investigating Officer and his statement was recorded. 7.
Considering the submissions made by the parties and considering the Case Diary, this Court finds it fit that the interim pre-arrest bail order may be made
Page No.# 3/3 absolute and it is also directed that the petitioner should fully comply with the directions mentioned in the said Order dated 28.07.2025. 8. Accordingly, the Anticipatory Bail Application stands disposed of. 9. Send back the Case Diary. JUDGE Comparing Assistant
