Singh Bisen, learned counsel for the applicant and Sri S.P. Tiwari, learned AGA for the State of U.P. as well as perused the record. The instant application has been filed seeking following main relief(s):- "For the facts and reasons mentioned in the accompanying affidavit, it is most respectfully prayed that this Hon'ble Court may kindly be pleased to quash the summoning order dated 18.02.2022 passed in Case No. 3551 of 2022 (State Versus Rajneesh Kumar Singh) passed by Chief Judicial Magistrate, Pratapgarh arising out of Case Crime No. 51 of 2021 under Sections 302, 504, 506, 34, 120-B of I.P.C. related to the Police Station Kohndaur, District Pratapgarh as well as charge sheet No. 86A of 2021 dated 29.01.2022 submitted in aforesaid case crime, in the interest of justice. The Hon'ble Court may also be pleased to stay the entire proceeding relating to Case Crime No. 51 of 2021 under Sections 302, 504, 506, 34, 120-B of I.P.C., Police Station Kohndaur, District- Pratapgarh, so far relates to the applicant in the interest of justice." At the very outset, Sri P.K. Singh Bisen, learned counsel for the applicant says that he may be permitted to withdraw the instant application with liberty to the applicant to file an appropriate application seeking discharge before the court concerned. The aforesaid has not been opposed by the learned AGA. In view of the above, the instant application is dismissed as withdrawn with liberty, as prayed for.
