Petitioner has essentially prayed for a direction to the respondents to consider his case in light of the decision rendered in State of H.P. and others Versus Om Prakash2.
2.
Learned Deputy Advocate General has placed on record copy of short reply on behalf of the respondents. In terms of the reply, present petitioner was one of the petitioners in Sh. was disposed of with direction to the respondents to consider the representation of the petitioners (therein) seeking applicability of the decision rendered in Om Prakash2. Learned Deputy Advocate General further submits that pursuant to Arvind Kumar3, respondents had considered the case of the petitioners (therein) including that of the present petitioner and vide office order dated 16.09.2024, relief sought by the petitioners was allowed. Petitioner’s name appears at Sr. No.56 of office order dated
16.09.2024.
3.
Since the relief prayed for by the petitioner in the present petition has already been granted by the respondents on 16.09.2024, it is not understandable as to how he instituted second writ petition on the same cause of action praying for the same relief.
At this stage, learned counsel for the petitioner made a fervent prayer seeking to withdraw the writ petition. Taking a lenient view in the matter, the present writ petition is dismissed as withdrawn. Pending miscellaneous application(s), if any, also stand disposed of.
