Present petition has been filed with the following prayer: "(i) Issue a writ, order or direction in the nature of Mandamus commanding/directing the opposite party nos.1 to 5 to dispossess the illegal encroachment of opposite party no.6 from the Gram Sabha land bearing Gata no.732/.008 hectare situated at Village - Sarvangpur, Pargana- Pahadapur, Tehsil- Colonelganj, District - Gonda and the copy of khatauni has contained in Annexure No. 1 to this writ petition." 2. Learned Standing Counsel, based upon instructions, states that there are no existing encroachment on the property in question. 3. In view thereof, no directions can be issued. However, the petitioner, if aggrieved, may move an appropriate application under the provisions of the U.P. Revenue Code. In case such an application is filed, the same shall be decided expeditiously in accordance with law. 4. Present petition stands disposed off in above terms.
