Order on Board 15/01/2025 1 This contempt petition under Section 12 of the Contempt of Courts Act, 1971 read with Article 215 of the Constitution of India has been preferred by the applicant for non-compliance of order (Annexure C-1) dated 29-9-2021 passed in WPS No. 5207/2021. 2 This is second round of contempt proceeding filed by the applicant. Earlier contempt case bearing Cont. “3. Considering the nature of ground raised in the contempt petition of non-payment of interest and taking note of the submission made by learned counsel for the respondents that interest has also been paid to petitioner along with three others at the rate of 6%, I do not find any good ground to continue with this contempt petition any further.
4. Accordingly, contempt proceedings initiated against respondents is hereby dropped. Notice issued to respondents stands discharged.
5. The contempt petition is accordingly closed.

Petitioner will be at liberty to file appropriate proceeding if he finds the amount of interest paid to him to be incorrect.” 3 In aforesaid contempt proceeding, applicant was granted liberty to file appropriate proceeding if he finds the amount of interest paid to him to be incorrect or he is not satisfied. 4 It has been conceded by learned counsel for the applicant that, admissible retiral dues as per respondents, have been paid to him. Vide order (Annexure C-1) dated 29-9-2021, WPS No. 5207/2021 was disposed of directing respondents No. 1 and 3 therein to immediately process the admissible retiral dues payable to the applicant. 5
Learned counsel for the applicant would submit that, retiral dues have been paid to the applicant, but all dues payable to him have not been paid and interest has also been wrongly calculated. 6 Having considered aforesaid contention of learned counsel for
3 respondents, since respondents have paid admissible retiral dues, as per them, payable to the applicant, therefore, no case for contempt is made out against the respondents. If the applicant is dissatisfied with the amount paid to him, then he may file appropriate proceeding for redressal of his grievance in accordance with law. 7 Accordingly, the rule issued to respondent/s is discharged and contempt proceeding is dropped.
