Neutral Citation No. - 2025:AHC:32530 Court No. - 5 Case :- WRIT - A No. - 1608 of 2025 Petitioner :- Garima Respondent :- Union Of India, Through Ministry Of Consumer Affairs, Food And Public Distribution And 2 Others Counsel for Petitioner :- Ashish Kumar Singh Counsel for Respondent :- A.S.G.I.,Hari Narayan Singh Hon'ble Ajay Bhanot,J. Heard Shri Ashish Kumar Singh, learned counsel for the petitioner, learned Standing Counsel for the respondent No. 1-State and Shri Mahendra Kumar Maurya, learned counsel holding brief of Shri Nishant Mehrotra, learned counsel for the respondents No. 2 & 3. The petitioner claims that her case on compassionate ground appointment has not been considered. A representation in this regard has been made to the competent authority but to no avail. The only prayer made on behalf of the petitioner is that her representation may be decided within a stipulated period of time. Shri Mahendra Kumar Maurya, learned counsel holding brief of Shri Nishant Mehrotra, learned counsel for the respondents No. 2 & 3 submits that the matter requires factual determination including the financial status of the family and other considerations as per applicable laws and Government Orders by the competent authority in the first
instance. However, he fairly contends that the purpose of appointment on compassionate ground will be defeated in case the appointments are not processed in a reasonable period of time. In light of the submissions made at the Bar and without going into the merits of the case, the respondent no. 3 i.e. Divisional Manager, Food Corporation of India, Divisional Office, Hapur is directed to decide the representation of the petitioner for grant of appointment on compassionate ground as per law within a period of four months from the date of receipt of a certified copy of this order along with a fresh copy of the representation. With the aforesaid direction, the writ petition is finally
disposed of.
