HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW MATTERS UNDER ARTICLE 227 No. - 5508 of 2025 Court No. - 30 HON'BLE MANJIVE SHUKLA, J. 1. Heard Sri Shivam Pandey, learned counsel for the petitioners, learned Standing counsel appearing for the Respondents No.1 and 2 as well as Sri Mohan Singh, learned counsel for the Respondent No.3. 2. In view of the proposed order, notice to Respondents No.4 and 5 is hereby dispensed with. 3. The captioned writ petition has been filed by the petitioners, inter alia praying therein for the following relief:- " To issue an order or direction to the opposite party no.2 i.e. Additional Commissioner (Administration), Ayodhya Divison, Ayodhya to decide the Appeal No.C 202304000000582, filed u/s-24 (4) of U.P. Revenue Code, 2006, with respect to the land in question i.e. Gata No.14 & 26 (situated in village-Atrawan, Pargana-Haveli Awadh, Tehsil-Sadar, District Ayodhya) within stipulated time framed in the interest of justice." 4. It has been contended on behalf of the petitioners that they have filed an Appeal under Section 24 (4) of U.P. Revenue Code, 2006 before the Additional Commissioner (Administration), Ayodhya Divison, Ayodhya in the year 2023 but the same is pending and has not been decided till date. 5. Learned counsel for the petitioners has argued that the legislature itself has provided under Rule 183 (4) of the U.P. Revenue Code Rules, 2016 Versus Counsel for Petitioner(s) : Shivam Pandey Counsel for Respondent(s) : C.S.C., Mohan Singh Smt. Sughra Devi And Another .....Petitioner(s) State Of U.P. Thru. Prin. Secy. Revenue, Lko. And Others .....Respondent(s) that the appeals are to be decided within a period of six months and if it is not possible to decide the appeal within the said time frame, the appellate authority shall record reasons for non disposal of the appeal. It has further been argued that from the order sheet of the appeal annexed with this petition, it is patently manifest that the appellate authority has not given any reason for non disposal of the said case since 2023. 6. Learned Standing counsel appearing for the Respondents No.1 and 2, on the other hand, has submitted that the ends of justice would be served if a direction is issued by this Court, thereby commanding the Respondent No.2 to consider and decide the appeal in question expeditiously, within a fixed time frame. 7. I have considered the submissions made by learned counsel appearing for the parties and I find that the appeal filed by the petitioners under Section 24 (4) of the U.P. Revenue Code, 2006 is pending before the Respondent No.2 since 2023. I also find that Rule 183 (4) of the U.P. Revenue Code Rules, 2016 categorically provides that the appeals are to be decided within a period of six months. 8. In view of the aforesaid reasons, this petition is disposed of finally with a direction to the Respondent No.2 to hear and decide the Appeal No.C 202304000000582,Smt Sughra Devi and others vs. Somai and others, expeditiously, preferably within a period of four months from the date of service of a certified copy of this order provided there is no legal impediment.
