Heard learned Counsel for the petitioner and learned Standing Counsel appearing on behalf of the respondent. 2. This petition has been filed with the following main prayer:- "issue a writ, order or direction in the nature of MANDAMUS commanding and directing to the Opposite Partie concerned to provide the Agreement/Physical Possession of the Pond land Gata No.347B/3.7560 hec. of the Village- Banauni, Pargana- Asiwan Rasulabad, Tehsil Hasanganj, District- Unnao expeditiously within the stipulate time as provide by this Hon'ble Court to the Petitioner in the interest of justice". 3. It is the case of the petitioner that the petitioner had participated in an auction held in pursuance of the advertisement issued for pond situated at Gata No.347B area 3.7560 Ha in Village Banauni, Pargana Asiwan Rasulabad, Tehsil Hasanganj, District Unnao and the Auction Committee had made a recommendation in his favour for grant of patta for ten years for the said pond land, but actual approval has not yet been given till date by the Appropriate Authority. Learned Counsel for the State Respondent has produced a copy of the instruction sent by the Sub Divisional Magistrate, Hasanganj, Unnao, wherein it has been stated that after notice was published inviting eligible Matsya Jivi Sahkari Samitis to make application with respect to the pond in question, two such Cooperative Societies had made application and on the basis of area of operation, the Samiti of Tajpur i.e. the petitioner's samiti was found eligible and the Area lekhpal was asked to submit a report in this regard. When the report came in his favour, the petitioner had deposited Rs.37,560/- for one year's lease hold rights on the said pond, but the then Sub Divisional Magistrate had not approved the report and the allotment was not done in favour of the petitioner's Samiti. As per the report of the Area Lekhpal dated 10.09.2025, Gata No.347B area 3.7560 ha in Village Banauni was found to be in possession of the petitioner and he is doing his fisheries operation on the same. However, till date allotment has not been done in his favour. 5. This petition is disposed of with a direction to the respondent no.2 to take an appropriate decision with respect to the allotment of the pond in question in favour of the eligible persons within a period of three weeks from today.
