1. Mr. D.S. Mehta, learned counsel for the applicant.
2. Mr. Tumul Nainwal, learned A.G.A. with Mrs. Meenakshi Sharma, learned Brief Holder for the State.
3. Mr. Saurabh Kumar Pandey, learned counsel for the complainant.
4. Present applicant Saleem, S/ o Umar @ Munna is praying for bail in relation to FIR dated 08.06.2025, bearing FIR No. 0173 of 2025, registered at P.S. Kiccha, District Udham Singh Nagar, wherein the present applicant has been implicated for the offence punishable under Sections 109 of BNS
5. It is contended by the
learned counsel for the applicant that the applicant is innocent and has been falsely implicated and this is a case of sudden provocation and even otherwise the charge sheet has been filed and there is no need of the custodial interrogation of the applicant. He further submits that applicant has no previous criminal history and is languishing in jail since 12.06.2025.
6. On the other side, Mr. Tumul Nainwal, learned A.G.A. has not disputed this fact that the charge sheet has already been filed and, as such, there is no need of custodial interrogation of the applicant, and furthermore the applicant has no criminal history.
7. On the other side, Mr. Saurabh Pandey,
learned counsel for the complainant also adopt the argument of the learned State Counsel.
8. After hearing the arguments of the
learned counsel for the parties and taking into consideration that the charge sheet has already been filed, and the applicant
2025:UHC:10276 has no previous criminal history, this Court is of the view that the present applicant deserves for bail.
9. Accordingly, without expressing any opinion on the merit of the case, the bail application is allowed.
10. Let the applicant
“Saleem” be released on bail on his executing a personal bond and furnishing two reliable sureties of the like amount to the satisfaction of the court concerned.
