Heard Shri Ajeet Kumar, learned counsel for applicant and Shri S.P. Tiwari, learned A.G.A. for the State and perused the record. Instant application has been filed seeking following main relief(s):- "i. To quash the entire proceeding of Case No.88 of 2025 "State Vs. M/s Gold Mark Infra Estate Private Ltd., through its Director Sri Nitish Kumar Verma" pending before Sub Divisional Magistrate, Nawabganj, Barabanki, ii. To quash the impugned notice dated 19.08.2025 issued by Sub Divisional Magistrate, Nawabganj, Barabanki under section 155 (2) of BNSS, 2023, contained as Annexure No.1, to this petition" Considered the facts including that with regard to gata i.e. Gata No. 1429/0.196 hectare, situated at Village - Khajurgaon, Pargana & Tehsil - Nawabganj, District - Barabanki, the applicant got sanctioned the map/layout plan and for other gatas, the applicant, who is involved in business of plotting, has not been submitted any application to get the layout plan sanctioned. On being confronted after taking note of the aforesaid, the learned counsel for the applicant stated that the instant application be disposed of with liberty to the applicant to file detailed objections before concerned Magistrate, which shall be decided as per law expeditiously. The aforesaid has not been opposed by learned AGA. In view of above this application is finally disposed of with liberty to the applicant to file detailed objections before the concerned Magistrate, which shall be decided as per law expeditiously.
