HON'BLE MR. JUSTICE ASHUTOSH KUMAR (V.J.)
Order 24/06/2025
1. The present bail application has been filed by the accused- applicant under Section 483 of the B.N.S.S., 2023 against the
order dated 16.01.2025 passed by learned Additional Session Judge No.1, Jaipur Metropolitan-II in Bail Application No. 33/2025 arising out of FIR No.171/2023, registered at Police Station Subhash Chowk, Jaipur for the offences punishable under Sections 147, 148, 149, 323, 341 & 302 IPC by which the bail application of the accused-applicant under Section 483 of B.N.S.S., 2023 has been dismissed.
2.
Learned counsel for the accused-applicant submits that accused-applicant has falsely been implicated in this case. Charge-sheet has been filed with the aid of Section 149 I.P.C. As per the finding of the charge-sheet, the allegations of causing fatal injury to deceased Iqbal has been attributed to co-accused Aditya
[2025:RJ-JP:23475] (2 of 3) [CRLMB-5574/2025] @ Ashu whose bail application has been dismissed as withdrawn by Co-ordinate Bench of this Court. The other accused persons Subham Mehra @ Golu, Jitendra Kashyap, Sanjay Mehra, Tarun Mehra, Rakesh & Nikhil were also found to be present on the place of occurrence. Though allegation of causing injuries to Iqbal and Alfaiz is also against the accused-applicant, however, the allegation of causing death of Iqbal is only on Aditya @ Ashu.
3.
Learned counsel further submits that charge-sheet has been filed against the present accused-applicant. The other similarly situated co-accused Subham Mehra @ Golu has been given benefit of bail in S.B. Criminal Misc. Bail Application No.15415/2024 (Subham Mehra @ Golu Vs. State of Rajasthan), co-accused Nikhil @ Nikku has been given benefit of bail in S.B. Criminal Misc. Bail Application No.15554/2024 (Nikhil @ Nikku Vs. State of Rajasthan), co-accused Yuvraj @ Raj Kashyap has been given benefit of bail in S.B. Criminal Misc. Bail Application No.882/2024 (Yuvraj @ Raj Kashyap Vs. State of Rajasthan), co-accused-Tarun Mehra has been given benefit of bail in S.B. Criminal Misc. Bail Application No.6810/2024 (Tarun Mehra Vs. State of Rajasthan) and co-accused Jitendra Kashyap @ Jugnu has been given benefit of bail in S.B. Criminal Misc. Bail Application No.4868/2024 (Jitendra Kashyap @ Jugnu Vs. State of Rajasthan) by Hon'ble Rajasthan High Court. The case of the present applicant is not different from that of co-accused persons who have already been enlarged on bail. The accused- applicant was arrested on 03.01.2025 and since then, he is behind the bars. Learned counsel also contends that the charge-sheet has
[2025:RJ-JP:23475] (3 of 3) [CRLMB-5574/2025] already been filed and trial will take long time to conclude, therefore, the accused-applicant be enlarged on bail. 4. On the other hand, learned Deputy Government Advocate vehemently opposed this bail application. 5. Heard learned counsel for the parties and also perused the material available on record. 6. Considering the overall facts and circumstances of the case; the fact that charge-sheet has been filed; the fact that causing fatal injury to deceased-Iqbal is on Aditya; also taking note of the fact that similarly situated co-accused have already been enlarged on bail by this Court; the accused-applicant was arrested on 03.01.2025 and trial will take long time to conclude, but without expressing any opinion on the merits/demerits of the case, this Court deems it proper to allow the bail application filed by the applicant. 7. Consequently, this bail application filed under Section 483 of the B.N.S.S., 2023 is allowed. It is ordered that accused-applicant namely Lakhan Mehra S/o Raju Mehra arrested in connection with FIR No. 171/2023, registered at Police Station Subhash Chowk, Jaipur shall be released on bail; provided he furnishes personal bond in the sum of Rs.50,000/- each and two solvent attested sureties of Rs.25,000/- each to the satisfaction of the Trial Court.
Applicant will be required to appear before that Court on all dates of hearing and as and when called upon to do so. (ASHUTOSH KUMAR (V.J.)), J AMIT/MAHIMA/43
