As could be seen from the above, the resolution does not specifically state that Panchayath had taken a decision to cancel the khata in respect of the property in question. However, observations have been are made regarding entitlement of the third respondent and his father over the said land. 4. It appears that on 23.05.2023, the Panchayath proceeded to cancel the khata standing in the name of the third respondent and the third respondent being aggrieved by this resolution preferred an appeal to the Executive Officer and the Executive Officer by the impugned order <ಾವNJೇ ಇLಾSೆಗಳನುI ಪ*8ಾಯಾI= ಾAರುವNಲ". 'ಾಗೂ ಾ0<ಾಲಯೆR Jಾ8ೆ ಸ7"ಸು8ಾಗ UBaೕಣೆR ಸಂಬಂಧಪಟQ JಾಖLಾಗಳ Xೕಲೂ ರುಜು ಾAರುವNಲ" 'ಾಗೂ Sಾೆ ಾAರುವ UBaೕಣವ ಸಹ ಈ HಾಗೆR ಸಂಬಂಧUರುವNಲ". ಇJೇ HಾಗೆR ಾಂಕ 21/05/1992 ರಂದು ಸಾರಂದ ಆಶ*ಯ dೕಜೆಯA ಹಕುR ಪತ*ವನುI UತಸLಾ=Jೆ. ಒ.ಎ\. ನಂ.217/88 ರ7" ಾಡ, ಅಗ*'ಾರ )ಾ*ಮದ ಲ1wಯ0; 2ಾಘವ2ೆAZ ಎಂಬುವರು '<ಾವNJೇ CಾT 'ೇ%ೆ 5ೕAರುವNಲ". ಆದeಂದ ಸದ HಾಗವನುI )ಾ*ಮದ ಅxವೃy)ೆ ೕಸ7ಡಲು ಸ>ೆಯು ಸ8ಾನುಮತಂದ ೕಾ5ಸLಾ-ತು. - 7 - NC: 2025:KHC:7630 WP No. 3711 of 2025 C/W WP No. 1815 of 2024 had directed to set aside the entry made in the records as grama thana and as a consequence of this order had also ordered for restoration of the name of the third respondent in the Register. Being aggrieved by this order, the present writ petition is filed. 5. As noticed above, the resolution passed by the Panchayath does not indicate that the Panchayath had resolved to cancel the khata. Obviously before cancelling the khata, the Panchayath would have to necessarily inform the khatedar, provide him opportunity to file objections and thereafter consider the same and pass orders regarding cancellation of the khata. In this case, the said procedure has obviously not been followed and only a resolution is passed wherein observations are made that the third respondent was not entitled to the property in question. 6. In my view, therefore, on the basis of the resolution dated 04.10.2022, the Panchayath cannot incorporate in the revenue register that the property is a grama thana. Consequently, a direction has to be issued - 8 - NC: 2025:KHC:7630 WP No. 3711 of 2025 C/W WP No. 1815 of 2024 to the Panchayath. In the event the Panchayath desires to cancel the khata in favour of the third respondent, it would have to necessarily notify the third respondent, provide him opportunity of filing his objections and also documents and thereafter consider the same and then pass an appropriate order. The impugned order would therefore necessarily have to be quashed and the Panchayath is given liberty to follow the procedure aforesaid in the event it resolves to examine the validity of the khata which had been registered in the name of the third respondent and his father. Writ Petition No. 3711/2025 stands disposed of. 7. Since the Panchayath itself has filed the writ petition, the petition filed by one of its members in Writ Petition No.1815/2024 would not be maintainable. At this stage, the learned Senior Counsel submits that the petitioner may be permitted to withdraw the writ petition. Accordingly, accepting the submission, W.P. The learned counsel for the Panchayath submits that the Panchayath does not propose to put up any construction or alter the nature and character of the property in question till the issue regarding khata is resolved.
