This anticipatory bail application under Section 438 and 440 of Criminal Procedure, 1973 has been preferred by the petitioner apprehending his arrest for offences registered under Sections 175, 379, 414, 34 of the Indian Penal Code, Sections- 21, 22 of the Mines and Minerals (Development and Regulation) Act, 1957 and Rules-54/4 of the Jharkhand Minor Mineral Concession Rules, 2004 and Rules 7, 9, 13 of the Jharkhand Minerals (Prevention of Illegal Mining, Transportation and Storage Rules, 2017, in connection with Azad Nagar P.S. Case No. 0038 of 2024 pending in the Court of learned Judicial Magistrate First Class, Jamshedpur 3. The allegation against the petitioner is that he is the owner of the hywa vehicle, which was transporting stone chips illegally. 4. Considering the nature of allegation, I am not inclined to grant anticipatory bail to the petitioner. Petitioner is directed to surrender and if he surrenders, his case will be considered by the Magistrate and the Magistrate will also take into consideration 2025:JHHC:11594 2 the orders passed in relation to the several other co-accused persons. 5.
