(2) Petitioner is studying in 8th Standard in Mohan Lal Sah Bal Vidya Mandir School, Mallital, Nainital. By means of this writ petition, petitioner has sought the following reliefs: “i. To issue a Writ, Order or direction in the nature of mandamus thereby commanding the Respondent no. 1 and 2 to not to mix the condition of National Means-Cum-Merit Scholarship Scheme (NMMSS) with conditions prescribed for Dr. Shivanand Nautiyal (SNSS) and State Merit (Sridev Suman) Scholarship Scheme (SMSS). ii. To issue a Writ, Order or direction in the nature of mandamus thereby commanding the Respondent no. 1 and 2 to allow the students of Private Unaided Schools (including Petitioner) to appear and participate in Dr. Shivanand Nautiyal (SNSS) and State Merit (Sridev Suman) Scholarship Scheme (SMSS).” (3) Learned Counsel for the petitioner points out that examination was schedule to be held today, which has already been held, however petitioner was not permitted to participate in the said examination only on the ground that she is studying in a private school. (4) Since the examination, in which petitioner wanted to participate, is over, therefore, the relief as claimed do not survive. Writ petition is, accordingly, dismissed as infructuous.
