This appeal has been preferred against the judgment of conviction and order of sentence dated 03.09.2008/04.09.2008 passed by learned Judge, Special Court, Karnal vide which the appellant has been convicted under Section 15(b) of NDPS Act and sentenced to undergo rigorous imprisonment for one year and imposed a fine of Rs. 10,000/- with default mechanism. 2. Learned State counsel, at the very outset, on instructions from Sub Inspector Sultan Singh submits that appellant has died on 19.07.2017 and photocopy of his death certificate has been produced in the Court. Same be retained on the case file. 3. In view of the above, proceedings against the appellant in the present appeal stands abated.
