The instant application has been filed seeking following main relief(s) :- "WHEREFORE, it is most respectfully prayed that this Hon'ble Court may kindly be pleased to quash the impugned summoning order dated 09.08.2024 and complaint dated 18.07.2023 contained as Annexure No. 1 and 2 to this application and every proceeding arising out of the same in complaint Case No.26199 of 2023 (Sanjay Kumar Soni @ Tej Kumar versus Radha Soni and others), in which summon the applicant No. 1 u/s 495 IPC and applicant no. 2 & 3 u/s 495 r/w 120B I.P.C, Police Station Dariyabad, District Barabanki pending in the court of Learned Additional Chief Judicial Magistrate, Court no. 23, Barabanki in the interest of justice." On account of some formal defects crept in the application, learned counsel for the applicants prays for withdrawal of the present application with liberty to the applicants to file afresh with proper pleadings and documents in support thereof.
