Notice to the complainant has been served as per the instructions of learned A.G.A, however no one has appeared on behalf of the complainant. Heard learned counsel for the applicant and learned A.G.A. for the State as well as perused the record. The accused-applicant seeks bail in Case Crime No.259 of 2025, under Section 137(2), 87, 64 (2) BNS AND 5/6 POCSO Act, Police Station Unchahar, District Raebareli. In the prosecution case, it is alleged that the minor daughter of the informant, aged about 17 years and 10 months, went missing from her house at about 5:00 a.m. on 19.06.2025. It is submitted that the victim has not levelled any allegation whatsoever against the applicant. According to her own statement, she is a major aged about 18 years. It is further submitted that no radiological examination was conducted by the Investigating Officer, and there is no corroborative evidence to support the prosecution case. Learned A.G.A. has opposed the prayer for bail but could not dispute the factual submissions advanced on behalf of the applicant. I have considered the rival submissions of learned counsel for the parties and perused the material on record. On due consideration of the facts and circumstances of the case, particularly the fact that the applicant has no criminal history, he is in custody since 04.07.2025, the charge sheet has already been filed, and the statements of the victim recorded under Sections 180 and 183 BNSS prima facie indicate that she was a consenting party, and without expressing any opinion on the merits of the case, I am of the considered view that the applicant is entitled to be enlarged on bail. Accordingly, the bail application is allowed. Let the applicant Shiva @ Shivakant be released on bail in aforesaid first information report number subject to his furnishing a personal bond and two reliable sureties each in the like amount to the satisfaction of the court below concerned with the following conditions: (i) The applicant will not tamper with the evidence during the trial.
