Learned counsel for the appellant submits that the appellant has falsely been implicated in the present case. It is further submitted that the charge sheet has already been filed and there is no possibility of tampering of any evidence. It is vehemently submitted that though not even a single evidence of active involvement or conspiracy of the appellant was found, but without considering all these facts, the trail court rejected the bail application of the appellant. It is, thus, submitted that the impugned order is liable to be set aside and the appellant, who is in jail since 10.08.2024, is also entitled for bail. 4. Learned A.G.A. vehemently opposes the prayer of the appellant, but does not dispute the fact that the allegation against the appellant is of conspiracy. He also concedes the fact that the charge sheet has already been filed. 5. Considering the arguments advanced by the learned counsel for the appellant, learned A.G.A. and going through the judgment of the trial court dated 10.09.2024, contents of the appeal as well as other relevant documents, it is evident that the allegation made against the appellant is of conspiracy. It is also evident that the appellant is in jail since 10.08.2024. In view of above facts and circumstances as also keeping in view the fact that the trial of the case is not likely to be concluded in near future, the appeal has substance and it is accordingly, allowed. 6.
