Heard learned counsel for the applicants and learned AGA for the State of U.P. as well as perused the record. The instant application has been preferred seeking following main relief(s):- "Wherefore, it is most respectfully prayed that this Hon'ble Court may graciously be pleased to quash the entire proceeding of case no. 947 of 2007 "Janki vs Shiv Prasad and others" as well as impugned summoning order dated 06.05.2009 issued in case no 947 of 2007 "Janki Prasad vs Shiv Prasad and other" by Chief Judicial Magistrate Balrampur under section 323,504,506,452 I.P.C. Police Station Tulsipur, District Balrampur as contained in Annexure no. 1 to this petition." At the very outset, learned counsel for the applicants says that justice would suffice if this application is disposed of with a direction to the Authority/Court concerned to consider and decide the application preferred by the applicants under Section 210 Cr.P.C./233 B.N.S.S. within the time as specified by this Court. The aforesaid has not been opposed. Considering the facts and circumstances of the case, as indicated, and prayer of the applicants' counsel as aforesaid, the present application is disposed of with a direction to the Court concerned to decide the application in issue most expeditiously.
