Admittedly, the punishment order dated 31.07.2007 was passed against the petitioner imposing minor penalty of fine equivalent to one month salary. No appeal or review was filed by the petitioner, who was a police constable, under Rule 20 or 23 of U.P. Police Officers of the Subordinate Ranks (Punishment and Appeal) Rules, 1991. Straightaway, on 01.04.2025 i.e. after 18 years, an application/representation was filed before the State Government under Rule 25 of the Rules, 1991 taking advantage of the fact that no limitation was prescribed for preferring the same. However, we are of the opinion that such application/representation, if at all, it could have been submitted, if no appeal had been preferred under the rules, 1991, within a reasonable time, certainly not after 18 years. The Tribunal cannot be faulted for having dismissed the claim petition as time barred. The claim petition, in fact, had become time barred even prior to filing of the application/representation under Rule 25 of the Rules, 1991. We are supported in taking this view by an earlier judgment in the case of Devendra Kumar Mishra vs. State of U.P., AIR Online 2021 All 2662.
