GP FOR SERVICES I 2 HCGR, J W.P.No.10823 of 2025 The Court made the following order: This Writ Petition is filed under Article 226 of the Constitution of India for the following relief/s:- “…to issue a Writ of Mandamus or any other appropriate writ, order or direction declaring the action of the 3rd respondent in issuing Suspension-cum-Show Cause notice vide Proceedings in R.C.No.918/H.R/Mydukuru/ 2024, dated 13-03-2025 against the petitioner without calling explanation and without following due procedure as contemplated under law as illegal, arbitrary and violative of Articles 14 and 21 of the Constitution of India apart from being violative of principles of natural justice and consequently direct the respondents No.3 to 5 herein to allow the petitioner to discharge his duties as Senior Mate/Field Assistant in Mittamanupalle Gram Panchayat, Mydukuru Mandal, YSR Kadapa District, and pass such other order or orders…” 2. Heard Sri P.Nagendra Babu, learned counsel for the petitioner, learned Assistant Government Pleader for Services-I for respondent No.1, Sri M.S.R.Chandra Murthy, learned Standing Counsel for respondent Nos.2 to 4 and Smt B.V.Aparna Lakshmi, learned Standing Counsel for respondent No.5. 3. Petitioner was appointed as Field Assistant at Mittamanupalle Gram Panchayat, Mydukuru Mandal, YSR Kadapa District, on 31.07.2009, by 5th respondent. Basing on certain allegations of 3 HCGR, J W.P.No.10823 of 2025 irregularities, he has been placed under suspension vide proceedings in Rc.No.918/H.R/Maidukuru/2024, dated 13.03.2025, issued by 3rd respondent and he was also called upon to submit explanation on the aforesaid allegations. Petitioner is stated to have submitted detailed explanation on 19.03.2025. However, the respondents have not proceeded further with the inquiry. Aggrieved by the same, petitioner preferred present writ petition assailing the suspension-cum-show cause notice. 4. Sri M.S.R.Chandra Murthy, learned Standing Counsel for respondent Nos.2 to 4 on instructions submits that petitioner has not submitted explanation dealing with the allegation of charges. Whereas, general explanation has been submitted and respondents are in the process of concluding the inquiry and the same will be decided soon. 5. In view of the aforesaid submissions, as the learned Standing Counsel has submitted that the explanation submitted by the petitioner does not dealt with specific allegation of charges, petitioner is permitted to submit further detailed explanation, within a period of one week from today. On submitting the same, the 3rd respondent is directed to proceed with the inquiry and conclude the same, in accordance with law, by providing an opportunity of hearing to the petitioner, within a period of thirty (30) days thereafter. 4 HCGR, J W.P.No.10823 of 2025 6. With the above directions, Writ Petition is disposed of. There shall be no order as to costs.
