THE DIRECTOR OF COLLEGIATE EDUCATION, ANDHRA PRADESH NAMPALLY HYDERABAD. ...RESPONDENT(S): Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue a writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the 1st respondent in not extending the benefit of exemption from passing the National Eligibility Test (NET) / State Level Eligibility Test SLET for allowing the UGC Scales, to the employees recruited between 16-7-2001 and 31-03-2004 on par with the employees recruited after 1-1-1986 and upto 16-7-2001 and prescribing acquisition of NET/SLET for extension of UGC pay scales as arbitrary, illegal and violative of Article 14, 16 and 21 of the Constitution of India and consequently set aside the said unconstitutional portion in Para 4 of the impugned G.O.Ms.No.140, dt.3-10-2005 and direct the respondent to extent the benefit of exemption of NET/SLET to the SC/ST Lecturers/Librarians/ Physical Directors, regularly required upto 31-03-2004, for allowing UGC pay scales and pass such other order or orders as this Hon’ble court may deem fit and proper in the circumstances of the case. IA NO: 1 OF 2005(WPMP 28071 OF 2005 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased stay the operation of the G.O.Ms.No.140, Higher Education (CE-II-I) Department dt.3-10-2005 in respect of the lecturers recruited after 16-07-200, pending disposal of the writ petition and pass such other order or orders as this Hon'ble court may deem fit and proper in the circumstances of the case. IA NO: 2 OF 2005(WPMP 28072 OF 2005 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased direct the 1st respondent to reconsider the issue of grant of exemption in respect of the SC & ST Lecturers/Librarians/Physical Director recruited after 16-07-2001 and upto 31-03-2004 by considering the representation dt.12-08- 2005 of the 1st respondent, letter dt.22-08-2005 and 24-08-2005 of the Chairman, AP. State SC & ST Commissioner and letter dt.27-09-2005 and 29- 09-2005 of the Hon'ble Ministers, pending disposal of the writ petition and pass such other order or orders as this Hon'ble court may deem fit and proper in the circumstances of the case. GP FOR EDUCATION The Court made the following order: It is brought to the notice of this Court that, as the petitioners’ counsel died, this Court ordered notices to the sole petitioners through registered post. The notice sent to the 1st petitioner was returned unserved with endorsement ‘Insufficient address’. In so far as petitioner nos.2 to 10 are concerned, notices were returned un-served with endorsement ‘Addresee Left’ whereas notices were served to petitioner nos.11&12. There is no representation for any of the petitioners today. It shows that the petitioners have no interest in prosecuting the matter. Since the matter is of the year 2005 and the petitioners are having no interest in prosecuting the matter, the writ petition is liable to be dismissed for non-prosecution. 2.
